Amend HB 2508 on third reading by striking the SECTION amending Section 2303.160, Occupations Code, and substituting the following:
SECTION 1.____. Sections 2303.160(b) and (c), Occupations Code, are amended to read as follows:
(b) A vehicle storage facility shall release a vehicle to an owner of the vehicle if the owner:
(1) presents:
(A) valid photo identification issued by this state, another state, a federal agency, or a foreign government; and
(B) proof of ownership or right of possession or control of vehicle, including [must accept] evidence of financial responsibility[, as] required by Section 601.051, Transportation Code; and
(2) pays the fees and charges for services regulated under this chapter and Chapter 2308, including charges for an incident management tow, as defined by Section 2308.002 [, as an additional form of identification that establishes ownership or right of possession or control of the vehicle].
(c) A [Subsection (b) does not require a] vehicle storage facility may require other documentation as required by a municipal ordinance, law enforcement agency, or governmental agency under which the tow was authorized [to release a vehicle to the owner or operator of the vehicle if the owner or operator of the vehicle does not:
[(1)
pay the charges for services regulated under this chapter or Chapter 2308, including charges for an incident management tow, as defined by Section 2308.002; and
[(2)
present valid photo identification issued by this state, another state, a federal agency, or a foreign government].
