Amend CSHB 3859 (house committee printing) as follows:
(1) On page 1, strike lines 16-19 and substitute "The provision of child welfare services should advance the best interest of the child, including placement with the person best able to provide for the child's physical, psychological, and emotional needs and development."
(2) On page 7, line 3, between "provider" and "to" insert "to act in a manner inconsistent with the best interests of the child or".
(3) On page 7, strike lines 6 through 11 and substitute the following:
(h) Notwithstanding any other law, the department shall exercise its duty as the child's managing conservator to make decisions in the child's best interest.
