Amend HR 3 (Adopting the Housekeeping Resolution for the House of Representatives of the 85th Legislature) by adding the following appropriately numbered SECTION to Article 3 of the resolution and renumbering the remaining SECTIONS of Article 3 accordingly:
SECTION 3.____. BIOLOGICAL SEX DESIGNATION FOR CERTAIN MULTIPLE-OCCUPANCY FACILITIES. (a) In view of every person's fundamental interest in privacy while in a state of undress, the house of representatives shall continue to designate any multiple-occupancy facility under the jurisdiction of the house to be used only by a person based on the person's biological sex.
(b)  In this section:
(1)"Biological sex" means the physical condition of being male or female, which is stated on a person's birth certificate.
(2)"Multiple-occupancy facility" means showers, changing rooms, and bathrooms designed or designated for use by more than one person at a time, where a person may be in a state of undress in the presence of another person, regardless of whether or not the facility provides curtains or partial walls for privacy.
(c)  This section does not prohibit the house of representatives from providing an accommodation, including the use of a single-occupancy facility. The house may not provide an accommodation that allows a person to use a multiple-occupancy facility accessible to a person that is designated for the biological sex opposite to the person's biological sex.
(d)  This section does not apply to a person entering a multiple-occupancy facility designated for the biological sex opposite to the person's biological sex:
(1)  for cleaning or maintenance;
(2)  to accompany a person needing assistance;
(3)  if the person is a parent or other person assisting a child; or
(4)  if the multiple-occupancy facility is temporarily designated for use by that person's biological sex.
(e)  The Committee on House Administration shall adopt policies as necessary to implement this section.
