Amend HR 4 (adopting the permanent rules of the house) as follows:
(1)  On page 75, strike lines 1-6, and substitute the following:
(4)  a statement indicating whether or not the bill or resolution expressly creates a criminal offense and if an offense is created, the statement must:
(A)  specify the culpable mental state (mens rea) applicable to the offense if it is expressly stated in the bill or resolution; or
(B)  indicate that the bill or resolution does not expressly state the culpable mental state applicable to the offense;
(4-a)  a statement indicating whether or not the bill or resolution expressly modifies the culpable mental state applicable to an existing criminal offense, expressly increases the punishment for an existing criminal offense or category of offenses, or expressly changes the eligibility of a person for community supervision, parole, or mandatory supervision;
(2)  On page 146, strike lines 18-26 and substitute the following:
(c)  A house bill that would create a criminal offense, modify the culpable mental state (mens rea) applicable to an existing criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision must include a short statement at the end of its title or caption indicating the general effect of the bill on the offense, culpable mental state, punishment, or eligibility, such as "creating a criminal offense," "modifying the culpable mental state," "increasing a criminal penalty," or "changing the eligibility for community supervision (or parole or mandatory supervision)."
