Amend Amendment No. 258 to CSSB 1 by Pickett (page 342 of the prefiled amendment packet) by striking lines 8 through 10 and substituting the following:

terms are defined by Section 372.001, Transportation Code, unless:

(1)  the funds are held in a subaccount created under Section 228.012, Transportation Code; or

(2)  the department requires repayment of the contribution by the entity on terms:

(A)  agreed to after negotiation between the department and the entity; and

(B)  approved by the Texas Transportation Commission.
