Amend CSSB 4 (house committee printing) as follows:
(1) On page 9, between lines 6 and 7, insert the following appropriately lettered subsection:
(____) A law enforcement agency is not required to perform a duty imposed by Subsection (a) with respect to a person arrested only for a Class C misdemeanor offense who has been determined to be a person with an intellectual disability by a court or by a local mental health authority or local intellectual and developmental disability authority.
(2) On page 12, between lines 22 and 23, insert the following appropriately lettered subsection:
(____) It is an exception to the application of this section that the person who was subject to an immigration detainer request described by Subsection (a)(1) was arrested only for a Class C misdemeanor offense and had, at the time the immigration detainer request was received, been determined to be a person with an intellectual disability by a court or by a local mental health authority or local intellectual and developmental disability authority.
