Amend CSSB 4 (house committee printing) as follows:
(1) On page 9, between lines 6 and 7, insert the following appropriately lettered subsection:
(____) A law enforcement agency is not required to perform a duty imposed by Subsection (a) with respect to a person who has provided documentary evidence of:
(1) a pending or approved application for asylum in the United States;
(2) admission into the United States in refugee status; or
(3) a pending or approved application for temporary protected status in the United States.
(2) On page 12, between lines 22 and 23, insert the following appropriately lettered subsection:
(____) It is an exception to the application of this section that the person who was subject to an immigration detainer request described by Subsection (a)(1) had previously provided documentary evidence of:
(1) a pending or approved application for asylum in the United States;
(2) admission into the United States in refugee status; or
(3) a pending or approved application for temporary protected status in the United States.
