Amend CSSB 316 (senate committee printing) in SECTION 6 of the bill, in added Section 481.0764, Health and Safety Code (page 5, after line 69), by inserting the following new subsection:
(a-1) Notwithstanding Subsection (a), a prescriber who issues a prescription for an opioid, a benzodiazepine, a barbiturate, or carisoprodol is not required to access the information under Section 481.076(a)(5) regarding the patient unless:
(1) the prescriber has previously issued a prescription to that patient for that same controlled substance in the three-month period preceding the instant prescription; or
(2) the prescriber is issuing multiple prescriptions under Section 481.074(d-1).
