Amend Floor Amendment No. 5 to CSSB 316 by Buckingham (85R21243) by striking the text of the amendment and substituting the following:

Amend CSSB 316 (senate committee printing) in SECTION 10 of the bill as follows:

(1)  Between "SECTION 10." and "Section 481.0764(a)" (page 7, line 27), insert "(a)".

(2)  Add the following appropriately lettered subsection to SECTION 10 (page 7, between lines 38 and 39):

( )  Notwithstanding Subsection (a) of this section, a specific type of prescriber or dispenser is not required to comply with any specific provision of this Act before September 1, 2020, if the Texas State Board of Pharmacy and the Texas Medical Board jointly determine that the system in which the information is reported under Section 481.076, Health and Safety Code, as amended by this Act, is, as of August 31, 2018, insufficient for use by that specific type of prescriber or dispenser under that provision.
