Amend SB 631 (senate committee report) as follows:
(1) Strike the recital to SECTION 1 of the bill (page 1, lines 21 and 22), and substitute the following:
Article 47.01a, Code of Criminal Procedure, is amended by amending Subsections (a) and (d) and adding Subsection (e) to read as follows:
(2) In SECTION 1 of the bill, following amended Article 47.01a(d), Code of Criminal Procedure (page 1, between lines 52 and 53), insert the following:
(e) The person who has the superior right to possession of the property, as determined in a hearing under Subsection (a), is responsible for any transportation necessary to deliver the property to the person as ordered under that subsection.
(3) Strike the recital to SECTION 2 of the bill (page 1, lines 53 and 54), and substitute the following:
Article 47.02, Code of Criminal Procedure, is amended by amending Subsection (b) and adding Subsection (c) to read as follows:
(4) In SECTION 2 of the bill, following amended Article 47.02(b), Code of Criminal Procedure (page 2, between lines 5 and 6), insert the following:
(c) The owner of the property is responsible for any transportation necessary to restore the property to the owner as ordered under this article.
