Amend SB 762 by adding the following appropriately numbered Subsection:
SECTION ____. It is a defense to prosecution under Section 46.02, 46.03, and this section for a code enforcement office holding a certificate of registration under Chapter 1952, Occupations Code, and in the performance of the officer's official duties possesses or carries an instrument or club used specifically for deterring the bite of an animal while the officer is on duty.
