Amend CSSB 1215 (senate committee printing) as follows:
(1) In SECTION 1 of the bill, in added Section 59.003, Business & Commerce Code (page 1, line 35), between the underlined period and "A contractor", insert "(a)".
(2) In SECTION 1 of the bill, following added Section 59.003, Business & Commerce Code (page 1, between lines 42 and 43), add the following:
(b) A contractor must disclose to the owner a condition discovered during construction that was not known or could not have reasonably been known at the time of design.
(c) A contractor who fails to disclose a condition as required by Subsection (b) may be liable for defects that result from the failure to disclose.
