BACKGROUND AND PURPOSE

 

Concerned observers note that recent legislative efforts relating to certain driver education courses resulted in conflicting requirements. H.B. 516 seeks to remedy this situation by requiring a driver's license application by an applicant under 25 years of age to state whether the applicant has completed a driver education course.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 516 reenacts Section 521.142(d), Transportation Code, as amended by Chapters 1253 (H.B. 339) and 1413 (S.B. 1317), Acts of the 81st Legislature, Regular Session, 2009, to conform to the age requirement set by Chapter 1413 (S.B. 1317), Acts of the 81st Legislature, Regular Session, 2009, requiring an application for an original driver's license by an applicant under 25 years of age to state whether the applicant has completed a driver education course.

 

H.B. 516 amends the Education Code to make a conforming change.

 

H.B. 516 repeals Section 521.1601, Transportation Code, as added by Chapter 1253 (H.B. 339), Acts of the 81st Legislature, Regular Session, 2009.

 

EFFECTIVE DATE

 

September 1, 2017.
