BACKGROUND AND PURPOSE

Concerned observers call for additional measures for the enforcement of traffic laws through the use of photographic traffic monitoring systems at intersections. H.B. 732 seeks to further deter traffic violations by requiring motorists approaching an intersection to be informed of a potential penalty that may result from a violation recorded by such a system.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 732 amends the Transportation Code to require the signs a municipality is required to install along each roadway that leads to an intersection at which a photographic traffic monitoring system is in active use that indicate the system's presence to also clearly indicate the range of the dollar amounts of the monetary penalties that may be imposed for a violation recorded by a photographic traffic monitoring system. The bill exempts a municipality from such a requirement if before September 1, 2017, the municipality has installed a sign along each roadway leading to such an intersection and indicating the amount of a monetary penalty that may be imposed for a violation recorded by the system.

September 1, 2017.
