BACKGROUND AND PURPOSE
Interested parties contend that some areas currently classified as small urban areas for purposes of the formula program for state transportation funding have exceeded the applicable population threshold yet continue to draw funding from the small urban allocation. H.B. 1140 seeks to remedy this situation by creating a new funding category for areas with larger populations.

CRIMINAL JUSTICE IMPACT
It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
H.B. 1140 amends the Transportation Code to change from urban, urbanized, and rural areas to large urbanized, small urbanized, and nonurbanized areas the areas to which the Texas Transportation Commission is required to allocate under the formula program the amount appropriated from certain sources to the commission each state fiscal biennium for public transportation. The bill defines "large urbanized area" as an urbanized area with a population of 200,000 or more and "small urbanized area" as an urbanized area with a population of less than 200,000.
