BACKGROUND AND PURPOSE

Interested parties contend that the terms used to refer to the individual who conducts a contested case hearing under the workers' compensation system have created confusion and inconsistency.

H.B. 2111 seeks to clarify that such individual is an administrative law judge.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2111 amends the Labor Code to clarify that the officer required to conduct a contested case hearing under the workers' compensation system is an administrative law judge.

H.B. 2111 amends the Insurance Code to make a conforming change.

EFFECTIVE DATE

September 1, 2017.
