AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 2379 amends current law relating to the provision of legal services to the office of inspector general of the Health and Human Services Commission.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 531.102, Government Code, by amending Subsection (a-3) and adding Subsection (a-7), as follows:

 

(a-3) Provides that the executive commissioner of the Texas Health and Human Services Commission (HHSC) is responsible for performing certain administrative support services functions necessary to support HHSC's office of inspector general, including, subject to Subsection (a-7), legal services.

 

(a-7) Defines "legal services" to include, for purposes of Subsection (a-3), only legal services related to open records, procurement, contracting, human resources, privacy, litigation support by the Texas attorney general, bankruptcy, and other legal services as detailed in the memorandum of understanding or other written agreement required under Section 531.00553 (Criminal Background Checks), as added by Chapter 837 (S.B) 200), Acts of the 84th Legislature, Regular Session, 2015.

 

SECTION 2. Effective date: upon passage or September 1, 2017.
