AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Channelview area is an unincorporated area of Harris County and residents contend that the local infrastructure is in need of rehabilitation.

 

H.B. 2351 creates the Channelview Improvement District, subject to voter approval at a confirmation election. The district has the authority to issue bonds. The district will help to replace and rehabilitate old and outdated infrastructure from the revenues raised by the collection of a one percent sales tax within the district.

 

This bill does not provide the district with the power of eminent domain, the authority to impose a property tax, or the ability to employ peace officers.

 

H.B. 2744 amends current law relating to the creation of the Channelview Improvement District, provides authority to issue bonds, and provides authority to impose fees and taxes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3943, as follows:

 

CHAPTER 3943. CHANNELVIEW IMPROVEMENT DISTRICT

 

Sets for the standard language for the creation of the Channelview Improvement District (district). Sets forth standards, procedures, requirements, and criteria for:

 

Creation, purpose, intent, public purpose, initial territory, confirmation, and election of the directors of the district (Sections 3943.001-3943.050);

 

Size, terms, election requirements, and provisions for the appointment of initial directors of the board of directors (Sections 3943.051-3943.100);

 

Powers and duties of the district (Sections 3943.101-3943.150);

 

General financial provisions and authority to impose a tax and issue bonds, including a requirement for a tax election (Sections 3943.151-3943.300); and

 

Dissolution of the district and administration of district property following dissolution (Sections 3943.301-3943.303).

 

Prohibits the district from exercising the power of eminent domain.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2017.
