AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Relating to the punishment for the offense of tampering with a governmental record; increasing a criminal penalty.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 37.10(c), Penal Code, by amending Subdivision (1) and adding Subdivision (5), as follows:
(1) Creates an exception under Subdivision (5).
(5) Provides that an offense under this section (Tampering with Governmental Record) is a state jail felony if it is shown on the trial of the offense that the governmental record was a payroll document requesting payment of compensation to a state officer or employee.
SECTION 2. Makes application of this Act prospective.
SECTION 3. Effective date: September 1, 2017.
