BACKGROUND AND PURPOSE

 

Interested parties note that river authorities are special districts that are subject to oversight by multiple entities but contend that the limited sunset review of these authorities may not be appropriate for this type of special district as sufficient oversight and regulatory requirements are already in place for these districts. H.B. 2802 seeks to address this issue by repealing provisions of law subjecting certain river authorities to limited review under the Texas Sunset Act.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 2802 repeals provisions that subject the following river authorities to limited review under the Texas Sunset Act: the Angelina and Neches River Authority, the Bandera County River Authority and Groundwater District, the Brazos River Authority, the Central Colorado River Authority, the Guadalupe-Blanco River Authority, the Lavaca-Navidad River Authority, the Lower Colorado River Authority, the Lower Neches Valley Authority, the Nueces River Authority, the Palo Duro River Authority of Texas, the Red River Authority of Texas, the Sabine River Authority of Texas, the San Antonio River Authority, the San Jacinto River Authority, the Sulphur River Basin Authority, the Trinity River Authority of Texas, the Upper Colorado River Authority, and the Upper Guadalupe River Authority.

 

H.B. 2802 repeals the following provisions:
