BACKGROUND AND PURPOSE
According to interested parties, the statutory medical authorization form required to be included with a notice asserting a health care liability claim is not compliant with certain federal law. H.B. 2891 seeks to address this issue by revising the form to be compliant with federal law.

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
H.B. 2891 amends the Civil Practice and Remedies Code to revise the medical authorization form for release of protected health information in a health care liability claim.

EFFECTIVE DATE
On passage, or, if the bill does not receive the necessary vote, September 1, 2017.
