BACKGROUND AND PURPOSE

 

Informed observers note that changes in law made by recent legislation to authorize the sale of antique and special interest vehicles by dealers located in Texas should be extended to accommodate national interest among dealers from other states who are interested in participating in the sale of these vehicles at Texas auctions for the purpose of generating tourism and vehicle sales tax revenue. H.B. 2963 seeks to address this issue by providing for the participation of these dealers in such an auction.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 2963 amends the Transportation Code to establish that, for purposes of the prohibition against engaging in business as a vehicle dealer without the appropriate dealer general distinguishing numbers, a domiciliary of another state who holds a dealer license and bond, if applicable, issued by the other state is not engaging in business as a dealer by buying, selling, including by consignment, or exchanging at a public auction an antique vehicle that is at least 25 years of age or a special interest vehicle that is at least 12 years of age or has been the subject of a retail sale.

September 1, 2017.
