BACKGROUND AND PURPOSE

Interested parties note the need to codify and amend the powers and duties of the Denton County Municipal Utility Districts Nos. 4 and 5 in order to help the districts better serve their local communities. H.B. 2987 seeks to achieve this goal.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2987 amends the Special District Local Laws Code to establish provisions relating to the Denton County Municipal Utility Districts Nos. 4 and 5. The bill grants the districts the power to undertake certain projects on roads in existence on September 1, 2017, subject to voter approval at an election called for that purpose. The bill expressly prohibits the districts from issuing bonds or other obligations to pay for a road project authorized by the bill. The bill provides for the validation and confirmation of certain district actions and proceedings taken before the bill's effective date.
