BACKGROUND AND PURPOSE

 

Interested parties express confusion regarding the procedure for filling a vacancy in a nomination in the general election for a state or county office with regard to the participation of certain precinct chairs in voting to fill the vacancy. C.S.H.B. 3100 seeks to address this issue by clarifying the voting requirement for filling such a vacancy.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 3100 amends the Election Code to clarify the voting requirement for filling a vacancy in nomination in the general election for a state or county office from a favorable vote of a majority of the members of a political party's state, district, county, or precinct executive committee, as applicable, present to a majority of such members voting.  

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2017.

C.S.H.B. 3100 differs from the original in minor or nonsubstantive ways by conforming to certain bill drafting conventions.
