BACKGROUND AND PURPOSE
Interested parties contend that
certain political subdivisions should have the authority to contract with a
broker to lease or sell a tract of real property that is owned by the subdivision.

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
C.S.H.B. 3178 amends the Local
Government Code to authorize a political subdivision, other than a home-rule
municipality or a county, to contract with a broker licensed under The Real
Estate License Act to lease or sell a tract of real property that is owned by
the political subdivision. The bill authorizes the political subdivision to
pay a fee if a broker produces a ready, willing, and able buyer to purchase a
tract of real property. The bill authorizes the political subdivision on or
after the 30th day after the date the property is listed, if a contract

On passage, or, if the bill does not receive the necessary vote, September 1, 2017.
