AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Interested parties note the ongoing research regarding early detection of ovarian cancer and contend that all federally approved tests to detect ovarian cancer should be made available to adult women in Texas. H.B. 3304 seeks to include any test or screening approved by the United States Food and Drug Administration for detecting ovarian cancer in the minimum required coverage for an annual medically recognized diagnostic examination for the early detection of ovarian cancer and cervical cancer provided by a health benefit plan to each woman 18 years of age or older enrolled in the plan.

 

H.B. 3304 amends current law relating to health benefit plan coverage for ovarian cancer testing and screening.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 1370.003(b), Insurance Code, as follows:

 

(b) Provides that coverage under this section (Coverage Required) includes at a minimum any other test or screening approved by the United States Food and Drug Administration for the detection of ovarian cancer. Makes nonsubstantive changes.

 

SECTION 2. Makes application of Section 1370.003, Insurance Code, as amended by this Act, prospective to January 1, 2018.

 

SECTION 3. Effective date: September 1, 2017.
