BACKGROUND AND PURPOSE

 

Interested parties note inconsistencies between state and federal law regarding parental notification of the placement of a teacher who does not meet certain standards. H.B. 3563 seeks to update the law to remove this inconsistency.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3563 amends the Education Code to replace an exemption for a school district that provides the required notice under federal law to a parent or guardian regarding a teacher who is not highly qualified from the requirement for a district that assigns an inappropriately certified or uncertified teacher to the same classroom for more than 30 consecutive instructional days during the same school year to provide written notice of the assignment to a parent or guardian of each student in that classroom with an exemption from that requirement for a district that provides the required notice under federal law to a parent or guardian regarding a teacher who does not meet certification requirements at the grade level and subject area in which the teacher is assigned.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2017.
