BACKGROUND AND PURPOSE

 

Interested parties contend that the prescribed fee for a county license for a junkyard or automotive wrecking and salvage yard is inadequate to cover the cost of the administration of a viable wrecking and salvage yard enforcement program in certain counties. C.S.H.B. 3997 seeks to remedy this situation by changing the prescribed fee for certain counties.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 3997 amends the Transportation Code to change the amount of the discretionary fee for the issuance or renewal of a county license for a junkyard or automotive wrecking and salvage yard in a county located on the Texas-Mexico border that has a population of less than 300,000 and contains one or more municipalities with a population of 200,000 or more from $25 to an amount, capped at $150, necessary to pay for the administration and enforcement of the ordinance requiring the license.

September 1, 2017.
