BACKGROUND AND PURPOSE

 

Interested parties contend that the authorization for an organization to hold an auction in which alcoholic beverages are auctioned is too limited. H.B. 4042 seeks to remove certain restrictions on conducting such an auction.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 4042 amends the Alcoholic Beverage Code to rename a temporary charitable auction permit as a temporary auction permit and to change the purpose for which such a permit holder may auction alcoholic beverages from raising money to support charitable works of the permit holder to raising money to support the stated purpose of the permit holder. The bill includes as entities to which the Texas Alcoholic Beverage Commission is authorized to issue a temporary auction permit a person or group of persons who are subject to recordkeeping requirements under Election Code provisions regarding political reporting. The bill removes the prohibition against a temporary auction permit holder conducting more than one auction during each calendar year.

 

H.B. 4042 amends the Tax Code to make a conforming change.

 

EFFECTIVE DATE

 

September 1, 2017.
