BACKGROUND AND PURPOSE

 

Interested parties in Comal County assert the benefits of changing the membership of the county juvenile board. C.S.H.B. 4307 seeks to provide for these changes.

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 4307 amends the Human Resources Code to include as a member of the Comal County Juvenile Board the judge of the 22nd District Court and to replace the member of the board who is a judge of a district court that has jurisdiction in Comal County, appointed biennially by the local administrative district judge, with the judge of the 274th District Court.

SECTION 1.  Section 152.0521(a), Human Resources Code, is amended to read as follows:

(a)  The Comal County Juvenile Board is composed of:

(1)  the county judge;

(2)  the judge of each county court at law in the county;

(3)  the judge of the 22nd District Court;

(4)  the judge of the 207th District Court;

(5) [(4)]  the judge of the 433rd District Court;

(6) [(5)]  an additional judge of the district courts having jurisdiction in Comal County, to be appointed biennially by the local administrative district judge; and

 

(7) [(6)]  the criminal district attorney of Comal County.
