BACKGROUND AND PURPOSE

 

Interested parties contend that an area within the city of Midlothian would benefit from the creation of a management district. H.B. 4347 seeks to provide for the creation of such a district.

 

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 4347 amends the Special District Local Laws Code to create the Midlothian Municipal Management District No. 3 to provide certain improvements, projects, and services for public use and benefit. The bill sets out provisions relating to such improvement projects and provides for, among other provisions, certain preconditions on the district exercising any powers granted under the bill's provisions, a change of the district's name, terms of employment and compensation for district employees, certain district contracting authority, and the dissolution of the district by ordinance of the City of Midlothian. The bill sets out the district's powers and duties, including water district powers, road district powers, public improvement district powers, municipal management district powers, and, subject to certain requirements, the authority to issue obligations, borrow money, impose assessments, establish user charges for nonpotable water for irrigation purposes, and impose property taxes. The bill grants the district certain rulemaking authority; prohibits the district from exercising the power of eminent domain; and exempts the district from statutory provisions generally applicable to municipal management districts that exempt certain residential property from district fees, assessments, and taxes.
