AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Interested parties note that, given the cultural importance of the Alamo and the pressures of tourist traffic and urban development, the Alamo and its surrounding area are in need of long term maintenance and oversight to protect the dignity and historical importance of the Alamo and its surrounding area from inappropriate development. H.B. 4349 seeks to address this need by providing for the creation of the Alamo Management District (district).

 

H.B. 4349 amends the Special District Local Laws Code to create the district to provide certain improvements, projects, and services for public use and benefit, including the protection and preservation of the Alamo shrine and the surrounding area. H.B. 4349 sets out the district's powers and duties, which include, subject to certain requirements, including requirements regarding special bond provisions, the authority to issue obligations and impose assessments and certain fees. H.B. 4349 prohibits the district from exercising the power of eminent domain and from imposing a property tax.

 

H.B. 4349 amends the Special District Local Laws Code by adding Chapter 3636.

 

H.B. 4349 amends current law relating to the creation of the Alamo Management District and provides authority to issue bonds.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3636, as follows:

 

CHAPTER 3636. ALAMO MANAGEMENT DISTRICT

 

Sets forth standard language for the creation of the Alamo Management District (district) in the City of San Antonio (city). Sets forth standards, procedures, requirements, and criteria for:

 

Creation, purpose, initial territory of the district, and conflicts (Sections 3636.001-3636.050);

 

Size, composition, appointment, and terms of the board of directors of the district (Sections 3636.051-3636.100);

 

Powers and duties of the district (Sections 3636.101-3636.150);

 

General financial provisions and obligations for the district (Sections 3636.151-3636.200); and

 

Dissolution of the district by the board (Section 3636.201).

 

Prohibits the district from exercising the power of eminent domain.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2017.
