BACKGROUND AND PURPOSE

Concerns have been raised that information written, produced, collected, assembled, or maintained by or for the military base realignment and closure task force could be detrimental to bases located in Texas if that information were to be made public while the task force is in existence. S.B. 751 seeks to postpone the abolishment of the task force and to make such information confidential and exempt from disclosure during the task force's existence.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

S.B. 751 amends the Government Code to postpone the date on which the military base realignment and closure task force is abolished and related provisions expire from September 1 2019, to September 1, 2021. The bill makes any information written, produced, collected, assembled, or maintained by or for the task force confidential and exempt from disclosure under state public information law during the task force's existence. The bill requires the task force, on abolishment, to transfer all information written, produced, collected, assembled, or maintained by or for the task force to the Texas Military Preparedness Commission and requires the commission to maintain that information. The bill makes any such information transferred to the commission public information subject to disclosure under state public information law.

September 1, 2017.
