BACKGROUND AND PURPOSE

Interested parties note a lack of authority for a groundwater conservation district to make certain disbursements of money by electronic means. S.B. 865 seeks to provide for such authority.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

S.B. 865 amends the Water Code to authorize a groundwater conservation district's board of directors to authorize payroll disbursements by electronic direct deposit. The bill excepts federal reserve wire transfers and electronic fund transfers from the requirement that disbursements of district money be signed by at least two directors. The bill gives a district board the option of allowing by resolution disbursements to be transferred by electronic means to accounts in the name of the district as an alternative to transference by federal reserve wire system and provides for disbursements to be transferred by such means or system to accounts not in the name of the district.

On passage, or, if the bill does not receive the necessary vote, September 1, 2017.
