AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

In the coming months, DFW Airport (airport) plans to roll out a program for travelers to reserve and pay for airport parking online. Because the airport is a public entity, there is concern that customer information like names, addresses, and financial information could be subject to the Public Information Act. There is no compelling reason to publicly release sensitive details about customers and their transactions. The legislature recognized this fact last session by passing S.B. 57, which protected the same information for customers of toll and transit authorities. Similarly, S.B. 1023 ensures that the information collected by the new parking system at the airport remains confidential. (Original Author�s / Sponsor�s Statement of Intent)

 

C.S.S.B. 1023 amends current law relating to the confidentiality of personal identifying information collected by certain airport governing boards.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter D, Chapter 22, Transportation Code, by adding Section 22.091, as follows:

 

Sec. 22.091. CONFIDENTIALITY OF CERTAIN INFORMATION COLLECTED BY JOINT BOARD. Provides that personal identifying information collected by a joint board for which the constituent agencies are populous home-rule municipalities is confidential and not subject to disclosure under Chapter 552 (Public Information), Government Code, if the information collected is in relation to a commercial online payment system and includes a person�s:

 

(1) name, address, e-mail address, and phone number;

 

(2) account number, password, payment transaction activity, toll or charge record, or credit, debit, or other payment card number; and

 

(3) other personal financial information.

 

SECTION 2. Effective date: upon passage or September 1, 2017.
