AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Interested parties contend that there is a need for a municipal management district within a certain area of Brazoria County. S.B. 1100 seeks to address this issue by establishing provisions relating to the creation of the Brazoria County Management District No. 1, providing authority to levy an assessment, impose a tax, and issue bonds, in order to administer and provide funding for economic development projects and services.

 

As proposed, S.B. 1100 amends current law relating to the creation of the Brazoria County Management District No. 1, provides authority to issue bonds, and provides authority to impose assessments, fees, and taxes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3944, as follows:

 

CHAPTER 3944. BRAZORIA COUNTY MANAGEMENT DISTRICT NO. 1

 

Sets forth standard language for the creation of the Brazoria County Management District No. 1 (district) in Brazoria County. Sets forth definitions, standards, procedures, requirements, and criteria for:

 

Creation, nature, purpose, confirmation and director's election, approval, and initial district territory of the district (Sections 3944.001-3944.050);

 

Size, composition, compensation, and election of the directors of the district, including temporary directors (Sections 3944.051-3944.100);

 

Powers and duties of the district (Sections 3944.101-3944.150);

 

General financial provisions and authority to impose certain taxes and issue bonds and other obligations (Sections 3944.151-3944.300); and

 

Dissolution of the district by the board (Section 3944.301).

 

Prohibits the district from exercising the power of eminent domain.�

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2017.
