BACKGROUND AND PURPOSE

 

Interested parties contend that certain statutory updates relating to a food manager on duty during the operating hours of a food establishment in certain large counties, such as Harris County, are needed to reflect population growth and the latest industry terminology and standards. S.B. 1158 seeks to provide these updates.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

S.B. 1158 amends the Health and Safety Code to raise from 2.8 million to 4 million the minimum county population threshold that triggers a county's authority to require a food manager to be on duty during the operating hours of a food establishment and to give such a county the option of requiring a certified food manager to be on duty during those hours as an alternative to requiring a trained food manager to be on duty during those hours.
