BACKGROUND AND PURPOSE

 

Interested parties suggest that it should be easier for certain persons to receive criminal history record information through the Department of Public Safety's (DPS) criminal history clearinghouse. S.B. 1299 seeks to reform access to criminal history record information.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

S.B. 1299 amends the Government Code to remove an individual's social security number from the information that a person entitled to receive criminal history record information through the Department of Public Safety's (DPS) criminal history clearinghouse must provide to DPS regarding the individual who is the subject of the criminal history record information requested by the person.

 

EFFECTIVE DATE

 

September 1, 2017.
