AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Presently, a person entitled to receive criminal history record information is required to provide social security number (SSN) of the individual whose information is being requested to the Texas Department of Public Safety (DPS) among other information. The proposed legislation prevents the collection of information that is not valuable to DPS, as criminal history clearinghouse is a fingerprint database�not an SSN database.
S.B. 1299 eliminates the clause "and social security number" from the list of information that must be provided to DPS in order to initiate the release of criminal history information to persons entitled to that release of information. The information required by statute would be:
� The full name, date of birth, sex, and the number assigned to any form of unexpired photo ID;
� A recent digital image photograph of the person;
� A complete set of the person's fingerprints (as required by DPS);
� Any other information required by DPS.
S.B. 1299 also excludes SSNs from the list of identifying numbers that may be required to be submitted to DPS.
As proposed, S.B. 1299 amends current law relating to access to criminal history record information.
RULEMAKING AUTHORITY
Rulemaking authority previously granted to the Texas Department of Public Safety is modified in SECTION 2 (Section 411.086, Government Code) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 411.0845(e), Government Code, to delete existing text, including the social security number (SSN) of the subject of requests for criminal history record information among certain information a person entitled to receive criminal history record information is required to provide to the Texas Department of Public Safety (DPS).
SECTION 2. Amends Section 411.086(b), Government Code, to exclude an SSN from the list of certain identifying numbers of an individual that rules adopted by DPS are authorized to require a person requesting the individual's criminal history record information to provide.
SECTION 3. Effective date: September 1, 2017.
