AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1815 amends the Texas Education Code by adding Section 61.0591, to make health-related institutions established after January 1, 2017, ineligible to receive formula funding unless the legislature specifically authorizes eligibility in the Education Code. (Original Author's / Sponsor's Statement of Intent)

 

C.S.S.B. 1815 amends current law relating to the eligibility of public institutions of higher education for formula funding for health-related institutions.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter C, Chapter 61, Education Code, by adding Section 61.0591, as follows:

 

Sec. 61.0591. ELIGIBILITY FOR CERTAIN FORMULA FUNDING. Provides that an institution of higher education (IHE) created on or after January 1, 2017, is eligible for formula funding established for health-related institutions under Section 61.059 (Appropriations) only if a statute created or authorized creation of the particular IHE or expressly provides that the particular IHE is eligible for that formula funding.

 

SECTION 2. Effective date: upon passage or September 1, 2017.
