AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The West Travis County Municipal Utility District No. 3 (district) is interested in amending its enabling act to make several revisions, including moving the date of the election for members of the district�s board of directors to the uniform election date in November. The revisions to the district�s enabling act would ensure that the district has the same enabling act language as neighboring West Travis County Municipal Utility District No. 5 in order to facilitate the possible future consolidation of the two districts. In addition, the movement of the district�s election date to the November general election would allow the district to coordinate its election with the various other governmental entities and would provide significant cost-savings to the district and local taxpayers. (Original Author�s / Sponsor�s Statement of Intent)

 

S.B. 2243 amends current law relating to the powers and duties and election of the board of directors of the West Travis County Municipal Utility District No. 3.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter B, Chapter 8440, Special District Local Laws Code, by adding Section 8440.052, as follows:

 

Sec. 8440.052. ELECTION DATE. Requires the West Travis County Municipal Utility District No. 3 (district) to hold an election to elect the appropriate number of directors on the uniform election date prescribed by Section 41.001 (Uniform Election Dates), Election Code, in November of each even-numbered year.

 

SECTION 2. Amends Section 8440.101, Special District Local Laws Code, as follows:

 

Sec. 8440.101. New heading: GENERAL POWERS AND DUTIES.  (a) Creates this subsection from existing text. Provides that the district has certain rights, powers, privileges, functions, and duties. Deletes existing text making the provision applicable to certain municipal utility districts.

 

(b) Prohibits the district, notwithstanding Subsection (a), from constructing, acquiring, operating, or maintaining a toll road.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2017.
