BACKGROUND AND PURPOSE

 

Interested parties note the need to codify and amend the powers and duties of the Lerin Hills Municipal Utility District of Kendall County in order to help the district better serve its local community. S.B. 2263 seeks to achieve this goal.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

S.B. 2263 amends the Special District Local Laws Code to establish provisions relating to the Lerin Hills Municipal Utility District of Kendall County. The bill grants the district the power to undertake certain road projects. The bill authorizes the district, subject to certain requirements, to issue obligations and impose a property tax. The bill establishes that the district retains all the rights, powers, privileges, authority, duties, and functions that it had before the bill's effective date. The bill provides for the validation and confirmation of certain actions and proceedings of the district's board of directors taken before the bill's effective date.

On passage, or, if the bill does not receive the necessary vote, September 1, 2017.
