AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Property owners on the western edge of the Bolivar Peninsula seek creation of an improvement district for approximately 37 acres, overseen by the Galveston County Commissioners Court, to promote maritime economic development. The district would assist in promoting the creation of terminaling, maintenance yard, and other facilities by providing dredging, infrastructure, utilities, and security.

 

The property is located north of the Intracoastal Waterway and a portion has historically been used for support of oil and gas exploration and storage The property is currently industrial and would not otherwise be developed for residential use. C.S.S.B. 2269 amends current law relating to creation of the Bolivar Management District, provides authority to issue bonds, and provides authority to impose assessments, fees, and taxes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3796, as follows:

 

CHAPTER 3796. BOLIVAR MANAGEMENT DISTRICT

 

Sets forth standard language for the creation of the Bolivar Management District (district) in Galveston County� Sets forth standards, procedures, requirements, and criteria for:

 

Creation and purpose of the district (Sections 3796.001-3796.050);

 

Size, composition, appointment, and terms of the board of directors of the district, including the naming of the initial directors (Sections 3796.051-3796.100);

 

Powers and duties of the district (Sections 3796.101-3796.150);

 

General financial provisions and the authority to impose a tax and issue bonds and obligations for the district (Sections 3796.151-3796.200); and

 

Dissolution of the district (Section 3796.201).

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all of the requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2017.
