AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 2276 amends the Special Districts Local Laws Code to establish the Lakewood Improvement District of Harris County to provide certain improvements, projects, and services for public use and benefit. The Lakewood Improvement District of Harris County would contain approximately 3,327.75 acres, located east and south of Lake Houston, partially within the corporate limits of the City of Houston and partially within the City of Houston's extraterritorial jurisdiction. The property is currently completely raw land owned by one entity.

 

S.B. 2276 would give the Lakewood Improvement District of Harris County the power to issue bonds and impose assessments, fees, or taxes to provide development facilities and amenities as the property is developed. (Original Author's / Sponsor's Statement of Intent)

 

C.S.S.B. 2276 amends current law relating to the creation of Lakewood Improvement District of Harris County, provides authority to issue bonds, and provides authority to impose assessments, fees, or taxes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3951, as follows:

 

CHAPTER 3951. LAKEWOOD IMPROVEMENT DISTRICT OF HARRIS COUNTY

 

Sets forth standard language for the creation of the Lakewood Improvement District in Harris County (district). Sets forth standards, procedures, requirements, and criteria for:

 

Creation, purpose, intent, and approval of the district (Sections 3951.001-3951.050);

 

Size, appointment, election requirement, compensation of the board of directors of the district, including provisions related to initial voting directors (Sections 3951.051-3951.100);

 

Powers and duties of the district (Sections 3951.101-3951.150);

 

General financial provisions and authority to impose a tax and issue bonds, including taxes and bonds relating to designated areas (Sections 3951.151-3951.350); and

 

Dissolution of the district (Section 3951.351).

 

Prohibits the district from exercising the power of eminent domain.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2017.
