A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to requirements regarding electronic access to |
|
instructional materials provided in printed book format purchased |
|
for public schools. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 31, Education Code, is |
|
amended by adding Section 31.036 to read as follows: |
|
Sec. 31.036. ACCESS TO PRINTED INSTRUCTIONAL MATERIALS IN |
|
ELECTRONIC FORMAT. (a) This section applies only to instructional |
|
materials or supplemental instructional materials provided in |
|
printed book format. |
|
(b) The publisher of instructional materials or |
|
supplemental instructional materials subject to this section |
|
purchased as provided by this chapter for a school district shall |
|
provide the district at no additional cost with access to the |
|
materials in an electronic format as provided by this section. |
|
(c) Instructional materials or supplemental instructional |
|
materials may be accessed in an electronic format under this |
|
section only for educational purposes by: |
|
(1) students enrolled in a course or subject for which |
|
the materials were purchased for the purpose of completing that |
|
course or subject and only for the period during which the student |
|
is enrolled; |
|
(2) teachers providing instruction in a course or |
|
subject for which the materials were purchased for the purpose of |
|
providing that instruction and only for the period during which the |
|
materials in printed book format are assigned for that course or |
|
subject; and |
|
(3) school and district administrators for a district |
|
campus at which a course or subject for which the materials were |
|
purchased is provided and only for the period during which the |
|
materials in printed book format are assigned for that course or |
|
subject. |
|
(d) The commissioner shall adopt rules to administer this |
|
section. |
|
SECTION 2. The change in law made by this Act applies only |
|
to instructional materials or supplemental instructional materials |
|
purchased under a contract entered into on or after the effective |
|
date of this Act. Instructional materials or supplemental |
|
instructional materials purchased under a contract entered into |
|
before the effective date of this Act are governed by the law in |
|
effect on the date the contract was entered into, and the former law |
|
is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2017. |
