A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a city attorney to seek an injunction |
|
|
to abate a common nuisance under the Alcoholic Beverage Code. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 101.70(b), Alcoholic Beverage Code, is |
|
|
amended to read as follows: |
|
|
(b) The county or district attorney in the county where the |
|
|
nuisance exists, the city attorney in the city where the nuisance |
|
|
exists, or the attorney general may sue in the name of the state for |
|
|
an injunction to abate and temporarily and permanently enjoin it. |
|
|
Except as otherwise provided in this section, the proceeding is |
|
|
conducted as other similar proceedings. |
|
|
SECTION 2. This Act takes effect September 1, 2017. |
