A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the applicability of competitive bidding requirements |
|
|
to leases of radio towers and the land under radio towers procured |
|
|
by the Parks and Wildlife Department. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter L, Chapter 11, Parks and Wildlife |
|
|
Code, is amended by adding Section 11.302 to read as follows: |
|
|
Sec. 11.302. LEASES FOR RADIO TOWERS AND RELATED LAND. The |
|
|
competitive bidding requirements of Subtitle D, Title 10, |
|
|
Government Code, do not apply to a procurement by the department of |
|
|
a lease for: |
|
|
(1) a radio tower; or |
|
|
(2) land underlying a radio tower. |
|
|
SECTION 2. Section 11.302, Parks and Wildlife Code, as |
|
|
added by this Act, applies to a lease procured by the Parks and |
|
|
Wildlife Department on or after the effective date of this Act. A |
|
|
lease procured by the department before the effective date of this |
|
|
Act is governed by the law in effect at the time the lease was |
|
|
procured, and the former law is continued in effect for that |
|
|
purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2017. |
