A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to prohibiting the use of an electronic device to film or |
|
|
photograph a traffic accident; creating an offense. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 545, Transportation Code, |
|
|
is amended by adding Section 545.428 to read as follows: |
|
|
Sec. 545.428. USE OF ELECTRONIC DEVICE NEAR TRAFFIC |
|
|
ACCIDENTS; OFFENSE. (a) In this section, "wireless communication |
|
|
device" has the meaning assigned by Section 545.425. |
|
|
(b) A person operating a motor vehicle may not use an |
|
|
electronic device, including a wireless communication device, to |
|
|
photograph or film a traffic accident. |
|
|
(c) This section does not apply to a police officer |
|
|
operating an authorized emergency vehicle equipped with a video |
|
|
camera. |
|
|
SECTION 2. This Act takes effect September 1, 2017. |
