A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a minimum balance prerequisite for the collection by |
|
|
mail of unpaid highway tolls and administrative fees. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 372, Transportation Code, |
|
|
is amended by adding Section 372.054 to read as follows: |
|
|
Sec. 372.054. MINIMUM BALANCE FOR COLLECTION BY MAIL OF |
|
|
TOLLS AND ADMINISTRATIVE FEES. Notwithstanding Sections |
|
|
228.0545(c), 228.055(b), 284.0701(b), 366.178(b-2), and |
|
|
370.177(c), a toll project entity may not: |
|
|
(1) send an invoice, notice of nonpayment, or other |
|
|
communication requiring the payment of an unpaid toll incurred by a |
|
|
vehicle or an administrative fee associated with that unpaid toll |
|
|
unless the total amount of unpaid tolls owed for the vehicle is $10 |
|
|
or more in a calendar year; or |
|
|
(2) increase the amount of an administrative fee or |
|
|
impose an additional fee for an unpaid toll in the period before a |
|
|
communication requiring payment of the toll is sent. |
|
|
SECTION 2. This Act takes effect September 1, 2017. |
