A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the ability of property owners to protest the adoption |
|
of municipal zoning regulations and boundaries. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 211.006(d), Local Government Code, is |
|
amended to read as follows: |
|
(d) Following a protest, [If] a proposed initial regulation |
|
or boundary or change to an existing regulation or boundary may |
|
[change to a regulation or boundary is protested in accordance with
|
|
this subsection, the proposed change must receive, in order to] |
|
take effect only on[,] the affirmative vote of at least |
|
three-fourths of all members of the governing body if the[. The] |
|
protest is [must be] written and signed by the owners of at least 20 |
|
percent of either: |
|
(1) the area of the lots or land covered by the |
|
proposed regulation or boundary [change]; or |
|
(2) the area of the lots or land immediately adjoining |
|
the area covered by the proposed regulation or boundary [change] |
|
and extending 200 feet from that area. |
|
SECTION 2. This Act takes effect September 1, 2017. |
