A BILL TO BE ENTITLED
 
AN ACT
  relating to the ability of property owners to protest the adoption
  of municipal zoning regulations and boundaries.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 211.006(d), Local Government Code, is
  amended to read as follows:
         (d)  Following a protest, [If] a proposed initial regulation
  or boundary or change to an existing regulation or boundary may
  [change to a regulation or boundary is protested in accordance with
  this subsection, the proposed change must receive, in order to]
  take effect only on[,] the affirmative vote of at least
  three-fourths of all members of the governing body if the[. The]
  protest is [must be] written and signed by the owners of at least 20
  percent of either:
               (1)  the area of the lots or land covered by the
  proposed regulation or boundary [change]; or
               (2)  the area of the lots or land immediately adjoining
  the area covered by the proposed regulation or boundary [change]
  and extending 200 feet from that area.
         SECTION 2.  This Act takes effect September 1, 2017.
